About these terms

These Terms of Service apply to your use of www.localfirstwebdesign.com (the "Site"), our chat widget, our forms, our text messages, and the services provided by Local First Web Design LLC ("Local First Web Design," "we," "us"), based in Mountain Grove, Missouri.

If we sign a separate quote, proposal or agreement with you for a project, that document controls where it differs from these terms. Our Privacy Policy explains how we handle your information.

Our services

We build websites and set up online services for small and local businesses, including Google Business Profile, social media pages, online payments and invoicing, domains, hosting and work email. The exact work, price and timeline for your project are set out in your quote or agreement.

Quotes and payment

  • Quotes are free and valid for 30 days unless the quote says otherwise.
  • Payment amounts, due dates and any deposit are set out in your quote, agreement or invoice.
  • Work outside the agreed scope is quoted separately before we start it.
  • Monthly services such as hosting or maintenance renew each month until you cancel.

Your responsibilities

  • Provide the content, photos, logins and feedback we need in a reasonable time. Delays on your side can move the timeline.
  • Make sure you have the right to use any text, photos, logos or other material you give us.
  • Review your site before launch and tell us about anything that needs fixing.

Ownership

Once your project is paid in full, you own the content, images and branding you provided and the finished website we built for you, as set out in your agreement. We may show your completed site in our portfolio unless you ask us not to.

The Site's own design, text and code belong to Local First Web Design LLC.

Third party services

Some of what we set up runs on other companies' services, such as Google, social media platforms, payment processors, domain registrars, hosting providers and email providers. Those services have their own terms and fees, and we are not responsible for their outages, policy changes or decisions about your accounts.

Hosting and maintenance

If we host or maintain your site, we will keep it updated and running as agreed. We aim for reliable service but cannot promise the site will never be down. If you cancel, we will help move your site and domain to you or another provider.

Text messaging (SMS) terms

Program: Local First Web Design LLC text messages.

What you will receive: messages about your inquiry, consultation scheduling and reminders, project and service updates, invoices and payment reminders, and occasional promotional offers.

How you join: by checking the optional SMS consent box on our Request A Call form or by giving consent in our chat widget. You must be at least 18 years old to sign up for text messages. Consent is not a condition of purchase.

  • Frequency: message frequency varies.
  • Cost: message and data rates may apply.
  • Opt out: reply STOP to any message to stop receiving texts. You will get one confirmation message, then no more.
  • Help: reply HELP, call (417) 344-8161, or email info@localfirstwebdesign.com.
  • Carriers: carriers are not liable for delayed or undelivered messages.
  • Privacy: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Use of the Site

Do not misuse the Site, try to break or overload it, or use our forms or chat to send spam or unlawful content.

Limitation of liability

The Site and our services are provided as they are. To the fullest extent the law allows, Local First Web Design LLC is not liable for indirect or lost profit damages, and our total liability for any claim is limited to the amount you paid us for the service involved in the 12 months before the claim.

Governing law

These terms are governed by the laws of the State of Missouri.

Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed.
